1. Who we are
Hermione Logic B.V., trading as Sweet-Discount Shop, runs this shop and the membership sold through it. We are established in the Netherlands, so the General Data Protection Regulation (Regulation (EU) 2016/679) and the Dutch Uitvoeringswet AVG govern what we do with personal data — wherever in the world you live when you buy from us.
We handle personal data fairly and lawfully, collect it only for reasons we have explained here, keep it secure, and do not pass it to anyone else except as set out below.
2. Who is responsible for your data
Hermione Logic B.V. is the controller of the personal data described in this policy. You can reach us at:
Company: Hermione Logic B.V.
Registered address: Grote Haag 85, 3893 CM Zeewolde, Netherlands
Email: [email protected]
We have not appointed a data protection officer. We are not obliged to: we do not monitor people systematically on a large scale, and we do not process special categories of data on a large scale. Write to us at the address above with anything about your data, and it will reach the person responsible for it.
3. Who else handles your data for us
Some of what we do relies on suppliers who handle personal data for us. Each acts on our instructions, under a contract, and only for what we have asked it to do. They fall into these categories:
- Hosting and email — the companies that run the servers this site sits on and send the messages we owe you, such as an order confirmation or a reply.
- Payments: PLACEHOLDER — name the payment provider. It takes card details directly and we never receive them.
- Delivery: PLACEHOLDER — name the carriers and any fulfilment partner, which receive the delivery address.
We use nothing for analytics or advertising, so nothing of that kind receives your data.
4. When we collect data, and what we collect
We collect personal data when you create an account, when you subscribe to the membership, when you place an order, and when you write to us. If you have only written to us, an email address is all we hold.
What we collect: your name, email address, delivery and billing address, telephone number, what you ordered and when, the correspondence between us, your IP address, and the times at which you used the site. Card details are handled by our payment provider — we never see or store them.
5. Why we collect it, and on what legal basis
Every purpose below is tied to one basis under Article 6 of the GDPR. Where the basis is consent you may withdraw it at any time, and doing so does not affect what we did with the data beforehand.
- Running your membership and fulfilling your orders — performance of the contract between us.
- Answering your questions and handling complaints, returns and refunds — performance of the contract, and our legitimate interest in dealing with people who write to us.
- Keeping accounting and tax records — compliance with a legal obligation. Dutch tax law requires seven years.
- Preventing fraud and keeping the shop secure — our legitimate interest in not being defrauded, weighed against your interest in not being profiled unnecessarily.
- Sending a newsletter — your consent, given by asking for it. Every newsletter carries an unsubscribe link.
We do not make decisions about you by automated means alone, and we do not profile you.
6. Children
This shop is meant for adults. We do not knowingly collect data about children, and if we discover we have, we delete it.
7. Who we share it with
Your data stays confidential. We disclose it only to the processors listed in section 3, who need it to do their job for us, and where the law or a court requires it. We do not sell personal data, and we do not share it for anyone else’s marketing.
8. Sending data outside the EEA
We sell to customers in France and United States, so a delivery address will reach a carrier in the country it is being sent to, and some of our processors may be based outside the EEA or store data there. Where a country has no adequacy decision from the European Commission, those transfers rely on the European Commission’s standard contractual clauses together with whatever additional measures the transfer needs.
9. How long we keep it
- Order and payment records: seven years from the end of the financial year, because Dutch tax law requires it.
- Account and membership data: for as long as the account is open, and two years after it closes.
- Correspondence: two years after the matter is closed.
- People who enquired but did not buy: one year after the last contact.
- Newsletter subscribers: until you unsubscribe.
10. Your rights
Under the GDPR you may ask us to:
- give you a copy of the data we hold about you, and tell you what we do with it;
- correct it where it is wrong, or complete it where it is missing something;
- delete it, where we have no reason to keep it;
- stop or limit what we do with it while a disagreement is sorted out;
- send it to you, or to someone else, in a portable form;
- stop using it where we rely on legitimate interest, including any use for direct marketing, which we will stop on request without exception.
Write to [email protected]. We answer within one month. We may ask you to prove who you are first, so that we do not hand your data to somebody else.
11. Complaints
If you think we have handled your data badly, please tell us first — most things are quickest to fix directly.
12. Cookies
This site sets only the cookies it needs to work: WooCommerce keeps your cart and your session, and WordPress sets one when you are logged in. Cookies that are necessary for a service you asked for need no consent, and these are the only ones we set.
We set no analytics or advertising cookies. If that ever changes we will ask your consent before the first one is set, which is what article 11.7a of the Dutch Telecommunicatiewet requires, and we will say so here.
13. Applicable law
This policy is governed by Dutch law. Nothing in it takes away the protection you have under the mandatory consumer or data protection law of the country you live in.
14. Changes
We may update this policy to keep up with the law or with changes to how the shop works. If a change matters to you, we will tell you by email or when you next log in. The date this version was published is shown below the title at the top of this page.
